SECTION 1 - DECLARATION & WAIVER

1.1 Accuracy of Information
I hereby confirm that all information provided is accurate and complete to the best of my knowledge.

1.2 Assumption of Risk
I understand that Brazilian Jiu Jitsu is a full-contact martial art involving grappling, throws, submissions, and physical exertion. I acknowledge that participation carries inherent risks, including but not limited to sprains, fractures, joint injuries, head injury, and in rare cases serious injury or death.

I voluntarily accept and assume all risks associated with participation.

1.3 Medical Declaration
I confirm that I am medically fit to participate in physical activity and have not been advised otherwise by a qualified medical professional.

I agree to inform the Academy of any injury, medical condition, or change in health that may affect my ability to train safely.

1.4 Personal Responsibility & Conduct
I agree to train responsibly and to follow all coaching instructions at all times.

I understand that I must stop training immediately if instructed to do so by a coach.

I accept full responsibility for my own safety and actions whilst participating in training.

1.5 Safety, Hygiene & Academy Standards
I agree to abide by all Academy rules, regulations, and dojo etiquette.

I agree to adhere to all safety, hygiene, and conduct policies, including uniform requirements, cleanliness standards, and injury reporting procedures.

1.6 Media Consent
I grant permission for photographs and video recordings taken during training to be used by the Academy for promotional and marketing purposes, including online platforms and electronic communications.

I understand that I may withdraw this consent at any time by providing written notice to the Academy.

1.7 Data Protection
I understand that my personal data will be processed in accordance with the Academy’s Privacy Policy (available using the following link: https://toukon.academy/privacy-policy/) and applicable data protection legislation.

Membership Terms*

SECTION 2 - MEMBERSHIP TERMS
(UPDATED APRIL 2026)

2.1 Membership Status
Upon successful completion of this application and acceptance by the Academy, individuals are considered members of Tōukon Academy®.

2.2 Payment & Billing
Membership fees are collected monthly on a recurring basis via Stripe and will continue until the membership is cancelled in accordance with these terms.

By signing up, I authorise the Academy to take recurring payments in line with my selected membership plan.

2.3 Failed Payments
If a payment fails, the Academy reserves the right to suspend access to training until payment is brought up to date.

Outstanding fees remain payable regardless of attendance.

2.4 Cancellation
A minimum notice period of 28 days is required to cancel any membership.

Notice must be submitted in accordance with the Academy’s stated cancellation process.

2.5 Non-Refundable Fees
Membership fees are non-refundable under any circumstances.

2.6 Non-Transferable Memberships
Memberships are non-transferable and may not be shared or assigned to another individual.

2.7 Absence from Training
Membership fees shall not be paused, refunded, or credited for any period of non-attendance unless otherwise agreed in writing at the sole discretion of the Academy.

2.8 Suspension / Freeze Policy
Memberships may only be paused or suspended at the sole discretion of the Academy.

Any agreed pause must be confirmed in writing.

2.9 Academy Access & Availability
Membership provides access to training sessions but does not guarantee attendance at any specific class or session.

2.10 Conduct & Termination
The Academy reserves the right to refuse, suspend, or terminate membership at any time, without refund, in cases of misconduct, unsafe behaviour, or breach of Academy rules, policies, or standards.

2.11 Price Changes
The Academy reserves the right to review and amend membership fees.

Members will be given a minimum of 30 days’ notice prior to any change.

2.12 Limitation of Liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence in accordance with the Unfair Contract Terms Act 1977.

Subject to this, the Academy shall not be liable for any indirect or consequential loss arising from participation or membership.

2.13 Personal Property
The Academy accepts no responsibility for loss, theft, or damage to personal belongings brought onto the premises.

2.14 Minors (if applicable)
For members under the age of 18, a parent or legal guardian must complete and agree to these terms on their behalf.
